WEST ELLICOTT – Target has filed a lawsuit challenging the tax assessment of the former K-mart store in West Ellicott where the company plans to open a new location.
Target Corporation filed the suit against the Town of Ellicott Board of Assessors in Chautauqua County Supreme Court on Tuesday.
The company claims the Town’s assessed value is “unlawful and illegal” under NYS Real Property Tax Law.
According to court documents, the town says the property is worth $3.4 million dollars while Target claims it is worth half the amount at $1.7 million dollars.
Last fall the company announced their intention to purchase the former K-mart store at 975 Fairmount Avenue in West Ellicott.
This would be the first time since August 2019 that a business will operate out of the location after K-mart closed as part of a nationwide cut back by their parent company Sears.
